The New York Times has filed a lawsuit against Microsoft and OpenAI, the creator of ChatGPT, accusing them of copyright infringement for using the newspaper’s content to train their large language models without permission. The lawsuit, filed in the Southern District of New York, seeks substantial damages for the alleged unlawful use of the Times's intellectual property. The Times argues that while it acknowledges the potential of generative AI, such technology should not commercially exploit journalistic content without consent. The lawsuit claims Microsoft and OpenAI's AI models directly compete with Times content, potentially impacting the newspaper's traffic and revenue. The Times is represented by Susman Godfrey, known for its representation in high-profile cases, including Dominion Voting Systems' defamation suit against Fox News. This case adds to the growing concerns among media organizations about using their content in training AI programs like ChatGPT, Dall-E, and others, without proper licensing or compensation.
