The U.S. Patent and Trademark Office (USPTO) has once again denied OpenAI's application to trademark the term "GPT," declaring it "merely descriptive" of the company's products and services, thus not meeting the criteria for trademark registration. This decision marks a setback for OpenAI's branding strategy, despite "ChatGPT" being one of the most recognized brands in the AI industry. The term GPT, short for "generative pre-trained transformer," is widely used beyond OpenAI, including by major companies like Amazon, to describe a specific type of AI model. The USPTO's rationale is that GPT directly describes the nature of the product, similar to attempting to trademark a common adjective in a product name. While this refusal limits OpenAI's legal control over the use of GPT-related branding, the company still holds significant market influence and recognition associated with the term. This situation could lead to the emergence of similarly named products, although OpenAI's pioneering role and market presence may continue to give it an edge in the AI space.
